Overview
This website is operated by Westminster Outdoor Living. Throughout the site, the terms “we”, “us” and “our” refer to Westminster Outdoor Living. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

Section 1 – General
We reserve the right to refuse service to anyone for any reason at any time. Including but not limited to: reasonable belief of a fraudulent transaction or abusive behaviour to staff at Westminster Outdoor Living.

Section 2 – Product or Service
While we have made every effort to display as accurately as possible the colours/images of our products, we cannot guarantee that your computer monitor's display of any colour will be accurate. All descriptions of product/pricing are subject to change anytime without notice. We also reserve the right to discontinue/withdraw from sale any product at any time.

All prices stated below are for retail orders only, all pricing for delivery of trade orders is on application.

Section 3 – Guarantees
Many of our products are constructed from more than one material and therefore will state “up to” on the guarantee. This means that part of the product is guaranteed for the time stated, and part of it will be for a shorter period. Please see the list below for the individual guarantee period of each material. Further guarantee information can be found in our T’s & C’s and “Materials” sections.

1 year guarantee applies to:
• Trade & Contract orders
• All Clearance items, due to discounted prices offered
• All items purchased at trade discount terms or for commercial use
• Parasols and bases
• All weather covers
• Electrical products
• Bean Bags

2 year guarantee applies to:
• Indoor upholstery fabric (100% Polyester)
• Enamelled Glass
• Aluminium
• Textilene Sling
• Pergolas, Blinds, louvres, solar LED lights

3 year guarantee applies to:
• Olefin Fabric
• Weave

5 year guarantee applies to:
• Sunbrella fabric
• Quick Dry Foam
• Sintered Stone Tops
• Teak
• PolyTeak


During the guarantee period, products will be repaired or have parts replaced at the discretion of the company, free of charge, provided that:
1. The product or any parts are returned to Westminster with proof of purchase. Westminster must be contacted prior to any arrangements to return any product and before any third-party repair is carried out.

2. Above products are guaranteed for the period of time listed which have been purchased for normal domestic use. Trade, Contract & Commercial supply comes with 1 year guarantee.

3. The product has not been misused or handled carelessly and has not been wilfully damaged, neglected or used in abnormal conditions. Please see Materials and Product Cleaning for guidance on maintenance.

4. The product has not been modified, altered or transformed in any way and repairs have not been attempted other than by Westminster staff or on their instruction. The guarantee will be valid only if maintenance has been carried out in accordance with Westminster furniture care instructions. Westminster will not be responsible for any defects to furniture due to the application of teak oil, stain or any other cleaning product.

5. The word “defects” as used in the guarantee is defined as imperfections that impair the utility of the product. The guarantee does not apply to normal wear and tear of the product such as wood checking, fading and weathering, however Viro weave comes with a 3 year guarantee against fading. Normal wear and tear is defined as “the normal deterioration that is received by regular use.” The guarantee does not cover dents, rips, scratches, superficial foam giving, mould or dirt. Issues where products are damaged on delivery will be investigated, and must be reported to Westminster within a 14 day window.

6. The guarantee does not cover damage, loss, or other conditions beyond the control of Westminster such as damage resulting from unauthorized repair, infestation, animals, negligence, misuse, improper handling or abuse, acts of God such including but not restricted to wind damage, hurricanes, tornadoes, floods, fire, and any other events due to natural causes.

7. Westminster cannot be held responsible for any loss/damage incurred if a parasol is kept open during windy conditions and an incorrect base stand is used. We strongly advise parasols are kept closed when not in use or in adverse weather conditions & the recommended Westminster base is purchased & used.

8. Pergola blinds must be stored within the provided cassettes during windy conditions and by keeping them exposed in windy conditions, you risk the material being ripped. In this event, we will not be held responsible for any damage.

9. The guarantee terms only apply to garden furniture products from our 2013 range onwards, purchased after the 1st of September 2012. For enquiries on any furniture purchased before this date please contact customerservices@westminsterfurniture.co.uk.

10. Non fault returns will only be accepted up to 14 days from time of purchase. Please see Delivery T’s & C’s for further information.

11. Faulty products will be collected for repair or replacement within UK mainland, this only applies when the item is within guarantee. Outside of this area it is the customer's responsibility to return and collect goods to and from Westminster Head Office in Uckfield. Alternatively a collection and return charge can be quoted that will need to be paid in full by the customer before we can accept return of the goods/products.

12. Replacements or repairs are only guaranteed for the remaining time left from the original purchase guarantee. If a replacement product is offered via a warranty claim then please be aware that this will not extend your existing warranty or start a new warranty. Any replacement is offered under the sales agreement, created when the purchase was made & this does not affect or change the original warranty time issued.

13. If a particular product is no longer available, Westminster reserve the right to use an alternative/similar product or substitute a current model.

14. The benefit of this guarantee cannot be transferred from the original purchaser.

15. This guarantee does not cover any rights other than those expressly set out above and does not cover claims for consequential loss or damage.

16. If for any reason we are unable to supply due to a technical or price/stock issue we aim to advise you within 24hrs & if applicable, will issue a full refund.

17. Is it Westminster’s decision how to resolve any complaints made under warranty, our decision will be final.

18. To obtain information or assistance on any warranty related issues please contact the retail store where the furniture was purchased or alternatively contact Westminster directly.

19. This guarantee is offered as an extra benefit and does not affect your statutory rights as a consumer.

Section 4 – Modifications to The Service of Products
Prices for our products are subject to change without notice. We reserve the right at any time to modify and/or discontinue any products or services without notice, at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the service/product.

Section 5 - Error, Inaccuracies and Omissions
Occasionally there may be information on our site or in the service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability etc. We reserve the right to correct any errors, inaccuracies or omissions and to change/update information/cancel orders if any information in the service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

Section 6 – Promotional Terms of Service and Use
Multiple promotional discount codes cannot be used in conjunction. A single promotional discount code cannot be applied to the same order more than once.
Promotions are non-transferable and cannot be exchanged for cash, vouchers or any other goods. If you make a return on an item purchased using the promotional discount, you will receive a refund for the promotional amount paid and not the full item value. We reserve the right to amend the promotional terms and conditions or terminate/discontinue the offer at any time without prior warning/notice period and for any reason.

Section 7 – User Comments, Feedback and Other Submissions
If, at our request, you send us specific content (for example images of your garden furniture), then you agree that we may at any time & without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any content and/or comments that you forward to us.

Section 8 – Communications
Please note by accepting our terms and conditions, you are agreeing to receive personalised commercial email communication from Westminster Outdoor Living. This may include information on exclusive offers, latest furniture trends or inspiration and style tips. You have the choice of unsubscribing at any time by selecting the ‘unsubscribe’ option on the email.

Section 9 – Changes to Terms of Service
You can review the most current version of the Terms of Service at any time via this page. We reserve the right to update/change/replace any part of these Terms of Service by posting updates and changes to our website at any time. It is your customer responsibility to check our website periodically for any changes. Your continued use of/access to our website (or the service) following the posting of any changes to these Terms of Service constitutes acceptance of those changes.



Section 10 - INDOOR FURNITURE Retail Agreement
This retail agreement ensures that the customer acknowledges their responsibility to check measurements and accept that the sofa will fit in their designated space, relieving the retailer from liability if the sofa does not fit.

Section 11 - Measurement and Fit Responsibility:

Section 11.1 - Customer's Responsibility to Measure
The Customer acknowledges and agrees that it is their sole responsibility to measure the intended space for the Sofa(s) before making the purchase. The Customer must ensure that the dimensions of the Sofa(s) will fit through all doorways, hallways, staircases, and any other access points to the intended location within their premises.

Section 11.2 - Acceptance of Fit
The Customer accepts full responsibility for ensuring that the Sofa(s) will fit in the designated space within their premises. By signing this Agreement, the Customer confirms that they have checked and are satisfied with the measurements and the ability to manoeuvre the Sofa(s) into the intended space.

Section 11.3 - Non-Liability of Retailer
The Retailer shall not be held liable for any issues related to the Sofa(s) not fitting into the intended space. This includes, but is not limited to, the inability to manoeuvre the Sofa(s) through doorways, hallways, staircases, or other access points.

Section 12 - Delivery and Installation

Section 12.1 - Delivery Conditions
The delivery of the Sofa(s) will be subject to the Customer ensuring that all pathways and the intended space are clear and accessible. The Customer agrees to be present at the time of delivery to inspect and accept the Sofa(s).

Section 12.2 - Installation
If applicable, the Retailer will provide installation services. The Customer acknowledges that the Retailer's installation team will not be responsible for any modifications to the premises to accommodate the Sofa(s).

Section 13 - Returns and Exchanges

Section 13.1 - Return Policy
Returns will only be accepted if the Sofa(s) are found to be defective upon delivery. Any claims for defects must be reported to the Retailer within 24 hours of delivery. The Customer agrees to provide photographic evidence of the defects.

Section 13.2 - Non-Acceptance of Fit
Returns or exchanges will not be accepted on the basis that the Sofa(s) do not fit into the intended space. The Customer's responsibility to measure and ensure fit, as outlined in Section 11, applies strictly.
